Privacy Policy

1. Introduction

This English text is an informational translation. The Ukrainian version of this document is the legally authoritative version.

This Privacy Policy explains how the "Повідомляка" service (фізична особа-підприємець Поляков Олексій Михайлович, Tax ID (РНОКПП) 3797501018; hereinafter — "we", the "Licensor") collects, uses, stores, and protects personal data when you use the https://povidomlyaka.com website, the Personal Account, and related services (hereinafter — the "Service").

2. Our roles with respect to data

With respect to the data of account holders and website visitors, we act as the controller of personal data. With respect to the personal data of End Recipients that the Customer processes through the Service, we act as a data processor on the Customer's instructions, and the Customer is the controller of such data.

Processing is carried out in accordance with the Law of Ukraine "On Personal Data Protection."

3. What data we collect

Account data: name, email, business name, phone number, payment details.

Data of End Recipients (on the Customer's behalf): name, phone number, messenger identifiers, message content and statuses, and appointment data from Altegio.

Technical data: IP address, browser type, actions within the Service, cookies, and analytics.

4. How we use data

We use data to provide, secure, and improve the Service; for authentication; billing; delivering messages via messengers and SMS; support; and legal compliance.

We do NOT use End Recipient data for advertising, targeting, training artificial intelligence models, or resale. Recipient data is processed solely to provide the Service on the Customer's instructions.

5. Legal bases

We rely on performance of a contract (provision of the Service), legitimate interests (security, abuse prevention, improvement), and consent (for non-essential cookies and email marketing). The legal basis for processing End Recipient data is ensured by the Customer.

6. Data transfers and subprocessors

To provide the Service, we engage trusted suppliers: cloud infrastructure, messenger and SMS providers, as well as Altegio and web analytics services. The full list of subprocessors is available at https://povidomlyaka.com/subprocessors.

Card payments are processed by the acquirer plata by mono (АТ «Універсал Банк»). With respect to payment card data, the acquirer acts as an independent controller (not our subprocessor) under Ukrainian law and its own terms (monobank.ua/terms-monobusiness). We do not receive or store full card data.

Messages are transmitted through the Meta/WhatsApp, Telegram, and SMS operator platforms. With respect to such messages, Meta acts as a processor under its own data processing terms. We do not sell personal data to third parties.

7. Retention periods

We retain data only for as long as necessary to provide the Service, comply with legal obligations, and resolve disputes. After use of the Service ends, data is deleted or anonymized within a reasonable time.

8. Data deletion and requests

You may submit a request to access, correct, or delete personal data to hello@povidomlyaka.com. We process such requests within the period prescribed by law. The Customer may also initiate deletion of End Recipient data that it processes through the Service.

9. Your rights

You have the right to access, correct, delete, and restrict the processing of your personal data, as well as the right to withdraw consent and to file a complaint with the Ukrainian Parliament Commissioner for Human Rights.

10. Security

We apply organizational and technical security measures (transmission encryption, access control, logging). Payment cards are processed by a PCI DSS-certified acquirer; we do not store full card data.

11. Cookies and analytics

The website uses cookies and web analytics tools to operate the site and improve the Service. You may manage cookies in your browser settings.

12. Children

The Service is intended for businesses and is not directed at persons under the age of 18; we do not knowingly collect their personal data.

13. Changes to this Policy

We may update this Policy by publishing a new version at https://povidomlyaka.com/privacy. Continued use of the Service after amendments take effect constitutes agreement with them.
